94 B Main Street (Savory Woods) – Informal Review

Present:  John Anderson, Esq.; Dean Kosch; Clayton Morin, Prof. Eng.; A. Couilliard.  Hearing opened at 7:26 pm.  

D. Kosch, 106 Main St., abuts Savory Woods.  He claims he has a lot of run-off coming onto his land from Savory Woods from the lower side of the property.  

M. Dempsey pointed out ConCom’s jurisdictional boundaries of wetlands is located at Savory Woods at the very top of the property, in the rear corner, which has a 100’ buffer zone.  He asked Mr. Couilliard to attend tonight’s meeting and he complied.  T. Grim pointed out that it may be out of ConCom’s jurisdiction.  

Atty. Anderson pointed out that the Determination of Applicability showed concern with erosion controls and that the site would be monitored.  He showed the Commissioners pictures of the property taken March, 2006, and May 10, 2006.  Some showed the flow of water with silt onto D. Kosch’s property.  T. Grim pointed out that there were 2 weeks of unusual rain this spring.   D. Kosch said this is an on-going situation and happens every time it rains.  

Couillard pointed out the plan where from one end of the stone wall to the other end, there’s  a two-foot berm with catch-basins for 200’.  He said there are forty-two, 5 x 5 precasted, perforated tanks, that are a concrete product with manholes going into them.  And then from there, there is a solid pipe which discharges it into the resource area.  It is inspected.  C. Morin said something is not working.   

M. Dempsey said that this needs to be separate from what happened this spring.  Half of the pictures are from May, 2006.  He’d like to see what was happening in that area before the project was built.  This might not be new.  

Couilliard pointed out that this plan was designed by Marchionda & Associates.  He also, through the 40B process, hires an independent consultant engineer, Dave Varga, Boston.  He said when you create a sub-division, you can’t have more run-off when you leave than when you started.  It’s been installed exactly to the plan, with two separate engineering companies saying there’s no run-off.  He said he had Varga and Marchionda walk the site.  He also said Leah Basbanes, wetland consultant has been monitoring it with reports.  

A. Couilliard said if there’s run-off going onto his (D. Kosch’s) property, he’ll fix it.  He will walk the project at the next rain-event site visit.  T. Grim said the next time it rains ½” to 1”, Commissioners will take a site walk to see where the water is coming from.  Hearing closed at 7:53 pm.  

Sliding Scale Review

Hearing opened at 8:02 pm.  ConCom conferred with the Mass. Asso. Of Conservation Commissioners about fees for COC’s.  Commissioners discussed and decided not to change our policy.  ConCom would always consider a waiver request if there is a hardship case.  Hearing closed 8:14 pm.  

M. Dempsey made a motion to close the hearing at 8:15 pm.  S. Benanti 2nd.  All in favor.  Unanimous.
